llA Wednesday, Jan. 13, 2010 Feather River Bulletin New Dyer owners make good on escrow account Sam Williams Staff Writer swillia ms@lassennews.com Dyer Management LLC, the new equity owner of a proposed 6,700-acre, four-season resort near Westwood, made good on its promise and recently deposited more than $200,000 into an escrow account to cover Lassen County's legal fees defending the project. According to the original developer agreement be- tween Dyer Mountain Associ- ates and Lassen County, the developer agreed to indemni- fy the county from any and all costs incurred through defending the project in court. The developer also agreed to make quarterly payments into an escrow account to pay the costs and fees of any legal defense of the project. In October 2007, Mountain Meadows Conservancy, the Sierra Club and Sierra Watch filed a lawsuit against Lassen County, the Lassen County Board of Supervisors and the original developer, Dyer Mountain Associates, in Lassen Superior Court alleging the county's approval of the project violated the California Environmental Quality Act. That legal action was put on hold when Dyer Mountain Associates filed for bankruptcy protection in 2008. At the board's Dec. 15 meet- ing, Michael Choo, a repre- sentative of Dyer Manage- ment LLC, the board and the new investment group agreed the new developer would bring the escrow account current by January. According to the agree- ment approved by the board last month, the new invest- ment group also would be allowed "to perform all oblig- ations and to assume all re- sponsibilities" of the original developer agreement. As part of that agreement, the new investment group also agreed to reimburse the county an estimated $42,947.94 in fees and costs in- curred to date in defense of the project. In addition, the new investment group agreed to pay $150,000 within 15 days---the equivalent of three quarterly $50,000 deposits-- into an escrow account the county may use to "timely pay litigation fees and expenses." Lassen County Counsel Craig Settlemire said Jan. 5 the Dyer Mountain invest- ment groups had deposited $271,083.92 in the escrow ac- count "to bring things cur- rent according to the assump- tion agreement" approved by the board last month. The new owners also will pay any future fees and costs within 30 days after being presented with an invoice from the county. Settlemire said Dyer Moun- tain Associates, the original developer, paid a $50,000 de- posit into the escrow account but soon filed for bankruptcy, and the quarterly payments ended. "The county is not out of pocket (for the legal fees and costs), and the new owner is now current," Settlemire said. Dyer Management LLC still owes more than $1.6 mil- lion in back property taxes, penalties and interest on the proposed four-season resort's real estate. As part of the assumption agreement approved in De- cember, the board required the .new owners to file a written repayment plan with the county within six months describing how it plans to settle its back tax debt. Almost 63 percent of Lassen County voters ap- proved a November 2000 bal- lot initiative that amended the county's General Plan, Zoning Ordinance and West- wood Area Plan to provide for development of Dyer Moun- tain and the surrounding area. The ballot measure changed the zoning of the area around Dyer Mountain and Walker Lake, also known as Mountain Meadows Reservoir. In September 2007, the board approved an environ- mental impact report and a large-lot parcel map dividing the resort property into 13 parcels ranging in size from 40 to 1,118 acres. The next month the environmental groups filed a lawsuit over the project. In 2008, Dyer Mountain Associates filed a petition for bankruptcy protection in federal bankruptcy court.
